1. **About Us**
Pioneer Holiday Lets Ltd (“we”, “us”, “our”) operates www.pioneerholidaylets.com (the “Website”). We are a private limited company registered in England and Wales. Registered office: 27 Old Gloucester Street, London, England, WC1N 3AX. Company number: C16775757.
2. **Purpose of the Website**
The Website is an advertising and booking-facilitation platform only. We allow caravan owners (“Vendors”) to list their holiday caravans and accept provisional or confirmed bookings from guests. We do **not** process or take any guest payments. All payments are arranged directly and privately between the Vendor and the guest outside of the Website.
3. **Acceptance of These Terms**
By creating an account, listing a property, accepting a booking, or using the Website in any way, you agree to these Terms and Conditions.
4. **Vendor Accounts, Listings and Bookings**
4.1 To list a caravan you must create a Vendor account and pay the annual listing fee of £69 (incl. VAT where applicable).
4.2 You are fully responsible for the accuracy of all details, photographs, pricing, availability calendar, and any house rules.
4.3 When a guest submits a booking request or you confirm a booking via the Website tools, a legally binding contract is formed directly between you (the Vendor) and the guest on the terms you have displayed. We are not a party to that contract.
4.4 You must honour all bookings you confirm unless exceptional circumstances apply (e.g., force majeure).
4.5 We may suspend or remove any listing or account that breaches these Terms, receives repeated complaints, or brings the Website into disrepute.
5. **Annual Listing Fee and Payment via Stripe**
5.1 The £69 fee is payable annually via Stripe and is non-refundable except where required by law (see clause 11).
5.2 Your listing remains live for 12 months from successful payment and can be renewed.
6. **Payments Between Guests and Vendors**
6.1 We do not handle, process, or hold any guest payments or deposits.
6.2 You must collect all payments (deposits, balances, security deposits, etc.) directly from guests using your own payment methods.
6.3 You are solely responsible for issuing receipts, handling refunds, and complying with tax obligations.
7. **Vendor Obligations**
You must:
– Keep your availability calendar accurate and up to date.
– Respond to booking requests promptly.
– Comply with all applicable laws (including fire safety, gas/electricity certification, licensing, and consumer protection rules).
– Honour the price and terms shown at the time the guest books.
8. **Intellectual Property**
You grant us a non-exclusive, royalty-free, worldwide licence to display the content you upload for the purpose of advertising your caravan on the Website and in related marketing material.
9. **Limitation of Our Liability**
9.1 The Website and booking tools are provided “as is”. We do not guarantee 100% uptime or error-free operation.
9.2 We are not liable for any contract, dispute, loss, or damage arising between Vendors and guests, including non-payment, cancellations, property damage, or personal injury.
9.3 To the fullest extent permitted by law, our total liability to you is limited to the listing fee you paid in the preceding 12 months.
10. **Cancellations and Refunds Between Vendor and Guest**
Your own cancellation policy (which you set and display on your listing) forms part of the contract with the guest. We are not responsible for enforcing or refunding under that policy.
11. **Your Cancellation Rights as a Vendor (Consumer cooling-off)**
If you are a consumer (acting outside your trade or business), you may cancel your listing contract within 14 days of payment and receive a full refund, provided your listing has not yet been made live.
12. **Data Protection**
We process personal data in accordance with our Privacy Policy. On request we will delete your account and listing within 30 days (subject to any legal retention requirements).
13. **Changes to These Terms**
We may update these Terms at any time. We will notify you by email or a notice on the Website. Continued use after changes means you accept the new Terms.
14. **Governing Law and Jurisdiction**
These Terms are governed by English law. The courts of England and Wales have exclusive jurisdiction.
